Here you can read our general travel terms and conditions that regulate the agreement between the traveler and the tour operator. These special travel terms and conditions replace and/or supplement, where applicable, the General Travel Terms and Conditions that have been developed by the Swedish Consumer Agency in collaboration with industry associations.
The following terms and conditions govern the contractual relationship between Experience Transylvania as a tour operator (hereinafter the "organizer") and the traveler (hereinafter the "traveler") when purchasing a package tour.
The traveler is responsible for ensuring that he/she has a complete and valid passport and other documents necessary for the trip, as well as, if circumstances require, a visa and the required vaccinations.New Paragraph
The traveler must have completed check-in for all flights included in the package trip in accordance with the itinerary or other instructions.ph
The traveler must comply with the regulations prescribed by the organizer or that apply to the services included in the package tour, such as hotels, airports, means of transport, etc.
The traveler must always behave in a way that does not inconvenience fellow travelers. Serious violations may result in the traveler being rejected by the organizer or its representative from further participation in the trip.
In such cases, the traveler must arrange for their own transportation home and bear the costs incurred in connection with this.
When concluding the contract, the traveler must inform the organizer of their nationality, including information about holding a Swedish or foreign passport and any dual citizenship, in order for the organizer to be able to fulfill its obligation to provide information about any passport and visa requirements. The organizer's obligation to provide information about passport and visa requirements only applies to EEA citizens.
The traveler must immediately upon receipt carefully review the confirmation, tickets and other travel documents and check that the information corresponds to what was agreed and that the name is spelled the same as in the passport. Any errors must be reported to the organizer immediately.
The traveler must immediately notify the organizer of any changes to address, email address, telephone number or other information of importance to the organizer's ability to contact the traveler.
The traveler must follow any rules specified by the organizer for reconfirmation of flights, which are included in individual trips and package trips without a tour leader. Failure to reconfirm means that the airlines concerned have the right to dispose of the reserved seats, and that the traveler may thus lose the right to use the remaining flights.
The traveler should keep up to date with departure locations and departure times, for example by checking information screens immediately after arrival at an airport and contacting airport staff if in doubt about which terminal or exit the flight departs from. This information changes frequently, which is beyond the organizer's control.
If the traveler has not complied with the above obligations, he/she cannot make claims against the organizer, intermediary or subcontractor of the package tour for the consequences that the traveler's failure to comply with these obligations entails.
Information in brochures and catalogues, including the Internet, is part of the contract. The information is binding on the organizer, unless the organizer has expressly reserved the right to make changes in the catalogue or brochure and the traveler has been informed of such changes before the contract is concluded. Experience Transylvania reserves the right to make changes to the program if this is done to improve the program.
The traveler must pay the price of the trip no later than the time stated in the contract. The organizer has the right to charge a first installment in connection with the conclusion of the contract (registration fee). If the full price of the trip is not paid at the conclusion of the contract, the remaining amount must be paid at the time specified by the organizer.
The price must be stated in such a way that the price of the entire trip is clearly stated. It must include all services included in the contract as well as mandatory supplements, taxes and fees.

If a package tour requires a minimum number of participants for the tour to take place, the organizer's marketing material must state how many participants are required for the tour to take place and the latest time when the traveler must have been informed that the tour will not take place. If the minimum number of participants required for the tour to take place is not reached, the organizer has the right to cancel the tour. In such cases, the traveler is not entitled to compensation.
Before the contract is concluded, the organizer must inform the traveler about passport and visa requirements and any health regulations that will apply during the trip.
The organizer's obligation to provide information about passport and visa requirements only applies to citizens of states within the European Economic Area (EEA). If the traveler is not a citizen of such a state, the traveler is responsible for finding out what applies to passport and visa requirements.
Before the contract is concluded, the organizer must provide the traveler with information about the possibility of taking out travel insurance and/or any cancellation insurance/protection. Cancellation insurance/protection cannot be added retrospectively. If the organizer offers cancellation insurance/protection and the traveler wishes to take out such insurance through the organizer, the traveler must inform the organizer of this at the latest when the contract for the purchase of the package tour is concluded.
The agreement becomes binding on the parties when the organizer has confirmed the traveler's order in writing.
The organizer must confirm the traveler's order without delay.
Price changes
If cost increases occur for the organizer after the agreement has become binding on the parties, the organizer may increase the price of the trip by an amount corresponding to the cost increases if these are due to:
In such cases, the price may be increased by an amount corresponding to the traveler's share of the increase in costs incurred by the organizer for the implementation of the agreement.
For example, if a fee increases by € 10 for each passenger, the price may be increased by the same amount. The right to a price increase as above only exists if the cost increase exceeds € 10.
The traveler's cancellation of the trip must be made in the manner specified in the agreement. Unless otherwise stated, the cancellation must be made in writing.
The cancellation cost is always at least € 100 per traveler.
The traveler's and the organizer's right to withdraw from the agreement due to force majeure.
Both the organizer and the traveler have the right to withdraw from the agreement if, after the agreement has become binding on the parties, a natural disaster, act of war, general strike or other intervening event occurs at or near the destination or along the planned route, which significantly affects the implementation of the trip or the conditions at the destination at the time the trip is to be carried out. If the traveler or the organizer withdraws from the agreement on the basis of this provision, the traveler is entitled to a refund of what he/she has paid under the agreement. If the organizer withdraws from the agreement on the basis of this provision, the traveler is not entitled to damages.
Cancellation protection and cancellation insurance
If the traveler has entered into an agreement on cancellation protection or cancellation insurance, the trip can be canceled in accordance with the special terms and conditions that apply to the cancellation protection or cancellation insurance.
The price does not include cancellation insurance. Experience Transylvania refers to ERV or other insurance companies regarding cancellation and insurance.
The traveler can protect themselves against cancellation costs for the trip by taking out cancellation insurance when registering.
Complaint
In the event of a fault in the agreed services, the traveller must immediately, after he/she has noticed or should have noticed the fault, complain to the tour operator, its representative or the subcontractor to whom the fault relates, in order to give them the opportunity to remedy the fault. Complaints should, if possible, be made at the destination.
If possible, the traveler should ensure that the complaint is documented in writing by the organizer or its subcontractor on site.
Limitations on the organizer's liability
The organizer's liability for claims due to damage or defects is limited to the applicable limits of the Warsaw and Montreal Conventions (for air transport) and the Athens Convention (for sea and inland waterway transport). The organizer's liability cannot therefore exceed that of the subcontractor(s) directly responsible for the defective service.
Airlines are directly responsible for the correct execution of transport according to the Warsaw and Montreal Conventions, EU Regulation 889/2002, EU Regulation 261/2004 and the Aviation Act.
The above means that in the event of delayed, lost or damaged luggage, the traveler must first complain to and make their claims against the contracting or transporting airline. The claims must be made as soon as the traveler becomes aware of the events. If possible, the loss or damage report must be made at the arrival airport, where a damage report (so-called PIR report) must be drawn up.
The organizer is not responsible for medications, any valuables such as cameras, cash, jewelry, etc., stored in checked baggage. Some airlines offer special insurance for items that are prone to theft. In such cases, a special declaration must be made directly to the airline upon check-in.
It should be noted that airlines often have agreements with each other about how they will handle each other's flights. To make it easier for the passenger in the event of complaints and grievances, according to the Montreal Convention, he/she always has the right to choose whether the claim should be made to the airline listed on the travel documents (the contracting party) or the airline that actually performs the transport (the carrying party).
The parties should attempt to resolve disputes concerning the interpretation or application of the agreement through negotiations.
If the parties cannot agree, the dispute can be heard by the Swedish Complaints Board or by a general court.
